RESOLUTION AUTHORIZING THE VILLAGE ADMINISTRATOR TO EXECUTE RENEWAL FOR PROPERTY AND LIABILITY INSURANCE COVERAGE WITH THE OHIO PLANE, DECLARING AND EMERGENCY

WHEREAS, the Village of Delta seeks liability coverage for a wide variety of activities and property.

WHEREAS, the Administrator has received, reviewed, and recommends the renewal of coverage with the Ohio Plan; and,

WHEREAS, the Village of Delta has been a member of the Ohio Plan since 1994 and has consistently quoted cost-effective premium for the proposed coverages.

NOW THEREFORE BE IT RESOLVED, by the Council of the Village of Delta, Fulton County, Ohio as follows:

SECTION I: The Village of Delta shall be insured with the Ohio Plan from July 1, 2024, to July 1, 2025.

SECTION 2: The Village Administrator shall be authorized to execute the required documents to secure property, casualty, and liability insurance with the Ohio Plan.

SECTION 3: That this resolution was passed and all actions and deliberations of the Council relating thereto were conducted in meetings open to the public pursuant to Section 121.22 of the Ohio R.C. 

SECTION 4: This Resolution shall take effect as an emergency measure becoming effective upon its passage, which is required to effectuate the renewal date of July 1, 2024, insuring protection of all village assets and matter involving liability.

AN ORDINANCE ACCEPTING THE APPLICATION FOR ANNEXATION OF CERTAIN PROPERTY TO THE VILLAGE OF DELTA, FULTON COUNTY, OHIO, AS PETITIONED IN ANNEXATION PETITION NO. 2024-2 BY DELTA ACRES, LLC., AND DECLARING AN EMERGENCY

WHEREAS, all actions as to Fulton County Annexation No. 2024-2 of certain property by the Village of Delta have been validated and approved by the Commissioners of Fulton County, Ohio on May 24, 2024; and

WHEREAS, this Council is desirous of completing the ratification of said annexation;

NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF DELTA, FULTON COUNTY, OHIO:

SECTION I: That the application of petitioners, Delta Acres. LLC., as submitted by Agent, Matt Gilroy, for the annexation of the following described territory in the County of Fulton, Township of York, and contiguous to the Village of Delta, Fulton County, Ohio is HEREBY ACCEPTED, said territory being particularly described as:

Exhibit A attached hereto and incorporated by reference herein.

An accurate map of said territory, together with the petition for its annexation and other papers relative thereto, and a certified transcript of the notices, actions and proceedings of the County Commissioners in relation thereto are on file with the Clerk of said Village. 

SECTION II: The acceptance of said territory for annexation is in accordance with the provisions Section 709.04 of the Ohio Revised Code.

SECTION III: It is hereby found and determined that all formal actions of this Council including any of its committees concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in such formal actions as contained herein were and are in compliance with all legal requirements as set forth by Village Charter.

SECTION IV: This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of said Village and its inhabitants and for the further reason that annexation of said territory provides for the controlled orderly growth and development of the Village.

WHEREFORE, this Resolution shall take effect and be in full force immediately after its passage as provided by law.

A RESOLUTION INDICATING THE VILLAGE OF DELTA, FULTON COUNTY, OHIO, WILL PROVIDE UTILITIES, FIRE AND POLICE PROTECTION SERVICES TO CERTAIN PROPERTY TITLED TO DELTA ACRES, LLC, WHICH HOLDERS ARE SEEKING ANNEXATION OF SAID PROPERTY PURSUANT TO FULTON COUNTY ANNEXATION PETITION 2024-3 TO THE VILLAGE OF DELTA, AND DECLARING AN EMERGENCY.

WHEREAS, it is the intention of this Council to provide utilities services, fire and police protection to certain property sought to be annexed to the Village of Delta, pursuant to Fulton County Annexation 2024-3 and the now record titleholders of said property being petitioner, Delta Acres, LLC,; and

WHEREAS, this Resolution for the provision of these services complies with Ohio Revised Code Section 709.023(C), and all applicable law.

NOW THEREFORE, Be It Ordained By The Council Of The Village of Delta, Fulton County Ohio, That:

SECTION I: That pursuant to Ohio Revised Code Section 709.023(C), and all applicable law, the Council of the Village of Delta hereby expresses its desire and intent to:

i) Provide, at the earliest opportunity permitted, sewer and/or water services, and fire and police protection to the following property sought to be annexed to the Village of Delta and described pursuant to Exhibit A hereto attached; and

ii) Based upon observation and review, said annexation parcel Exhibit A does not appear to be contrary to zoning uses or provisions of ORC § 303 or ORC § 519. In the event upon annexation of the territory, the Village of Delta shall determine any incompatible zoning uses under current County or Township Regulations in adjacent township territory, the Village of Delta shall, upon establishing final zoning under the Village of Delta Zoning Code for the annexed parcel, provide for “appropriate buffer space,” within the meaning of ORC § 709.023(c) and impose provisions for same upon the annexed parcel; and

iii) Further, the Village of Delta shall maintain any and all applicable streets or highway areas, if any, segmented by the annexation of the subject areas, which streets or highways may pursuant to law become subject to the jurisdiction of the Village of Delta.

SECTION II: That the Administrator of the Village is hereby directed to deliver a copy of this Resolution to the Clerk of the County Commissioners and proceed to do all things necessary and proper for the final approval of said annexation.

SECTION III: It is hereby found and determined that all formal actions of this Council concerning and relating to the adoption of this legislation were adopted in an open meeting of the Council and that the deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements as mandated by the Charter of the Village of Delta.

SECTION IV: This Resolution is hereby declared to be an Emergency Measure necessary for the immediate preservation of the public peace, health and safety of said Village and its inhabitants, and for the further reason that this Resolution is necessary to provide for the future planning, orderly growth and development of the Village of Delta and surrounding environs and to meet the time requirements set forth in the Ohio Revised Code

WHEREFORE, this Resolution shall take effect and be in full force immediately after its passage as provided by law

AN ORDINANCE SPECIFYING THE APPROVAL OF THE COUNCIL OF THE VILLAGE OF DELTA, FULTON COUNTY, OHIO, OF THE PENDING ANNEXATION PETITION NO. 2024-3 OF DELTA ACRES, LLC TO ANNEX PROPERTY TO THE VILLAGE OF DELTA, FULTON COUNTY, OHIO, AND DECLARING AN EMERGENCY

WHEREAS, Delta Acres, LLC has caused to be filed Petition No. 2024-3 with the Commissioners of Fulton County, Ohio; and

WHEREAS, this Council is desirous of expressing its approval and acceptance of said annexation petition as filed herein;

NOW THEREFORE, Be It Ordained By The Council Of The Village of Delta, Fulton County Ohio, That:

SECTION I: That the petition for annexation of certain lands titled to Delta Acres, LLC, to the Village of Delta, Fulton County, Ohio from York Township, Fulton County, Ohio, has been filed with the Fulton County Commissioners and captioned Annexation Petition No. 2024-3 – Exhibit A.

SECTION II: This Council hereby expresses its consent and approval as to the annexation of said lands to the Village of Delta. Further, this Council states that by separate Resolution No. 03-2024 it has heretofore agreed to provide Village utility, fire and police services to said lands once same are annexed to the Village of Delta, Fulton County, Ohio.

SECTION III: The express intent of Council herein is in conformity with ORC §709.023(D) and/or all applicable law.

SECTION IV: It is hereby found and determined that all formal actions of this Council including any of its committees concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in such formal actions as contained herein were and are in compliance with all legal requirements as set forth by Village Charter.

SECTION V: This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of said Village and its inhabitants and for the further reason that annexation of said territory provides for the controlled orderly growth and development of the Village and that it is necessary to meet the time requirements set forth in the Ohio Revised Code.

WHEREFORE, this Ordinance shall take effect and be in full force immediately upon its passage and approval.

AN ORDINANCE DESIGNATING CERTAIN ROADWAYS AS NOT BEING THROUGH STREETS, AND DECLARING AN EMERGENCY

WHEREAS, Due to the closure of an exit from the Ohio Turnpike, truck traffic has increased on certain roads located within the Village of Delta; and

WHEREAS, This is causing deterioration of these roadways, which were not constructed for the increased truck traffic within the Village, and also causing safety concerns for the drivers within the Village; and

WHEREAS, Ohio Revised Code Section 4511.65 allows the Council for the Village of Delta to designate certain streets as “Not Through Streets”; and

WHEREAS, Council desires to designate certain streets as “Not Through Streets” in accordance with the attached Exhibit “A”.

NOW THEREFORE BE IT ORDAINED by the Council of the Village of Delta, Fulton County, Ohio as follows:

SECTION 1: The Council for the Village of Delta hereby adopts the attached Exhibit “A” and designates the streets described therein as “Not Through Streets.”

SECTION 2: The Administrator of the Village of Delta or his designee are hereby directed to place proper signage to provide that the streets as “Not Through Streets.”

SECTION 3: That this Ordinance was passed and all actions and deliberations of the Council relating thereto were conducted in meetings open to the public pursuant to Section 121.22 of the Ohio R.C.

SECTION 4: This Ordinance is deemed an emergency measure, necessary for the immediate preservation of the public health, safety and welfare, and for the further reason that it is in the best interests of the Village and its inhabitants to eliminate the increased truck traffic that has taken place recently on these roadways.

This ordinance shall take effect on the earliest possible date allowed by law.
